College of Law Discusses the Enforcement of Judicial Judgments in Civil Proceedings

The College of Law at Al-Nahrain University discussed the Master’s thesis entitled “The Enforcement of Judicial Judgments in Civil Proceedings”, submitted by Ru’a Ghalib Sami, a postgraduate student in the Department of Private Law.

The significance of the research stems from the fact that the enforcement of a final judicial judgment constitutes the decisive stage in achieving judicial protection of rights. The effectiveness of judicial judgments is not complete merely upon their issuance; rather, it is realized through their enforcement and the delivery of rights to their rightful holders. The study also highlights the legal effects arising from a judgment acquiring final and conclusive status, particularly its binding effect, enforceability through compulsory execution, and the stability of legal positions.

The importance of the research is further enhanced by the obstacles and legal issues that may arise during enforcement procedures and may require the temporary suspension of enforcement. This necessitates examining the legal rules governing such suspension in a manner that balances the judgment creditor’s interest in obtaining their rights with the judgment debtor’s interest in protection from potential harm resulting from enforcement. The study also acquires particular significance in light of recent technological developments and the opportunities they provide for improving judicial enforcement procedures and enhancing their efficiency and speed.

The research aims to clarify the legal framework governing the enforcement of final judicial judgments and to analyze the legal effects resulting from a judgment acquiring final and conclusive status. It also addresses cases in which enforcement procedures may be suspended, together with their grounds and legal requirements. Furthermore, the research seeks to assess the adequacy of the applicable legislation in addressing practical issues encountered in judicial enforcement and to examine the role of electronic means and modern technologies in developing and expediting enforcement procedures, thereby contributing to the achievement of prompt justice and ensuring a balance between the rights of the parties to the dispute.

Following the discussion and examination of the thesis by the committee, the committee decided to accept the thesis subject to amendments and recommended awarding the student the Master’s degree.
