Al-Nahrain University College of Law Discusses the Legal Framework of Startups T

 

he College of Law at Al-Nahrain University discussed the Master’s thesis entitled “The Legal Framework of Startups: A Comparative Study”, submitted by Sinaa Mohammed Abdul-Hussein, a postgraduate student in the Department of Private Law.

Significance of the Study

The significance of this study stems from its examination of startups as a modern subject with important economic and legal dimensions, given their direct impact on achieving economic and social development and enhancing the investment and innovation environment. The existence of an integrated legal framework regulating these economic entities is considered essential to ensuring their success and continuity through provisions governing their establishment, financing, and management, as well as providing an appropriate legal environment for their growth.

The study also derives its significance from examining a number of comparative legislations in countries that have achieved tangible success in supporting startups and developing the digital economy. This provides an opportunity to benefit from their legislative and regulatory experiences in developing the Iraqi legal framework in a manner consistent with contemporary economic and technological developments.

Objective of the Study

This study aims to examine the legal regulation of startups under the legislations subject to comparison, through analyzing the legal rules governing their establishment, incorporation requirements, and the procedures necessary for their formation. It also examines the legal mechanisms designed to support their financing, as well as the financial and non-financial incentives granted to them.

Furthermore, the study seeks to present a proposed legislative vision for developing the Iraqi Companies Law or establishing a specific legal framework for startups, in a manner that takes into account the particularities of the Iraqi economic environment and the latest technological developments, while contributing to supporting entrepreneurship and encouraging innovation and investment in emerging ventures.
