The College of Law at Al-Nahrain University discussed the PhD dissertation entitled “The Legal Framework for Insider Trading in the Stock Market: A Comparative Study”, submitted by Ghassan Qahtan Khalaf, a doctoral candidate in the Department of Private Law.
Objectives of the Study
Through a comparative analysis of relevant laws, this study aims to identify the strengths and weaknesses of the Temporary Securities Market Law No. (74) of 2004 and its Implementing Regulation No. (16) of 2011 issued pursuant thereto, and to assess the adequacy of their provisions in addressing unlawful practices in the stock market.
The study also seeks to mitigate the adverse effects resulting from such practices, particularly those that undermine the principle of equality among investors and give certain investors an unfair advantage over others. This is pursued through proposing legal formulations that contribute to strengthening legal protection and achieving justice and equality among all investors in the stock market.
