College of Law Discusses “The Legal Status of the Ship Agent: A Comparative Study

The College of Law at Al-Nahrain University discussed the PhD dissertation entitled “The Legal Status of the Ship Agent: A Comparative Study”, submitted by Fatima Bashir Al-Araji, a doctoral candidate in the Department of Private Law.

Significance of the Study

The significance of this study stems from the important role played by the ship agent in carrying out maritime transport operations. The ship agent performs legal and commercial activities related to the delivery of goods, collection of freight charges, and representation of the carrier in certain transactions, giving rise to legal consequences that affect the rights and obligations of the parties to the maritime relationship.

Despite the importance of this role, the legal status of the ship agent continues to raise a number of issues concerning the determination of its legal nature, the scope of its powers, and its responsibilities. This highlights the need for a specialized legal study of this status that contributes to clarifying its governing rules, determining its legal effects, and identifying shortcomings in its legislative regulation, thereby contributing to greater stability in maritime transactions.

Objectives of the Study

This study aims to determine the legal status of the ship agent and clarify its legal nature through an analysis of legislation, maritime conventions, legal scholarship, and judicial decisions. It also seeks to determine the scope of the ship agent’s powers, obligations, and responsibilities, and to clarify the legal effects arising from its actions in relation to the parties to the maritime relationship.

Furthermore, the study aims to identify shortcomings in the legislative framework governing the ship agent’s activities and to propose appropriate legal solutions that contribute to developing the legal provisions governing the legal status of the ship agent.
