College of Law Discusses “The Legal Framework of Tripartite Legal Relationships: A Comparative Study”
The College of Law at Al-Nahrain University discussed a PhD dissertation entitled “The Legal Framework of Tripartite Legal Relationships: A Comparative Study,” submitted by Farah Kareem Fartous, a doctoral candidate in the Department of Private Law.
The dissertation addressed modern developments in legal transactions that have given rise to tripartite legal relationships—arrangements in which multiple interests and wills intersect within a unified legal framework, extending beyond the traditional bilateral debtor-creditor dynamic.
The study aimed to elucidate the legal foundation of these relationships, assessing the extent to which they fall under the General Theory of Contract, and exploring whether they constitute an independent legal trend driven by modern economic and technological advancements.
The research established that third parties occupy an independent legal position within these relationships, fostering balance and stability in legal transactions. It also highlighted a legislative gap in Iraqi law and addressed difficulties concerning the compatibility of tripartite relationships with the principle of privity of contract (relativity of contractual effects). Ultimately, the study proposed a comprehensive legal framework to contribute to the evolution of the General Theory of Obligation and keep pace with contemporary developments in legal transactions.
