الاعلام و العلاقات الثقافيةThe College of Law at Al-Nahrain University discussed the PhD dissertation entitled “Institutional Reform of the Administrative Judiciary in Iraq: A Comparative Study”, submitted by Mohammed Sattar Jabbar Bdan, a doctoral candidate in the Department of Public Law.
Significance of the Study
The significance of this study lies in addressing a subject closely connected with achieving the principle of the rule of law and consolidating the foundations of the legal state. The administrative judiciary constitutes a fundamental mechanism for overseeing the actions of public administration and ensuring its compliance with the law. Accordingly, institutional reform of the administrative judiciary is not limited to developing the judicial system alone; rather, its impact extends to strengthening the protection of public rights and freedoms and achieving a balance between public authority and the rights of individuals.
The significance of this study also stems from the pressing need to develop the legal framework of the administrative judiciary in Iraq, particularly in light of the expansion of public administration activities and the increasing number of administrative disputes. This requires an efficient and independent administrative judiciary capable of resolving administrative disputes with speed, effectiveness, and fairness.
The study is also significant from a practical perspective, as it seeks to identify the shortcomings and obstacles that limit the effectiveness of the administrative judiciary in Iraq and propose appropriate solutions and mechanisms to address them, thereby contributing to strengthening the independence of the administrative judiciary and enhancing its institutional efficiency.
Objectives of the Study
This study aims to examine the extent to which the administrative judiciary in Iraq requires institutional reform in a manner that strengthens its independence and effectiveness in protecting legality, rights, and freedoms.
This is pursued through examining reforms concerning the composition of the administrative judiciary, particularly with regard to the selection, appointment, and promotion of judges, as well as ensuring their independence and impartiality. The study also examines the rules and procedures of litigation before the administrative judiciary and identifies the shortcomings that hinder effective access to administrative justice.

Following the discussion and evaluation of the dissertation, the committee decided to accept the dissertation subject to the required amendments and recommended awarding the student the PhD degree.
