الاعلام و العلاقات الثقافيةThe College of Law at Al-Nahrain University discussed the master’s thesis entitled “The Role of the Federal Supreme Court in Consolidating the Manifestations of Duality of Powers under the Parliamentary System”, submitted by Hawraa Hafidh Mahdi, a postgraduate student in the Department of Public Law.
Significance of the Study
The significance of this study stems from the important role played by the Federal Supreme Court in establishing the principle of balance between the legislative and executive branches under the parliamentary system adopted by the Constitution of the Republic of Iraq of 2005.
This system is based on cooperation and balance between the two branches, which necessitates the existence of a constitutional judicial body responsible for regulating the boundaries of each branch’s jurisdiction and preventing either branch from encroaching upon the powers of the other. Accordingly, the significance of the study lies in examining the role played by the Federal Supreme Court in strengthening this balance and regulating the relationship between the legislative and executive branches in a manner that ensures respect for the principle of separation of powers and prevents either branch from gaining predominance over the other.
Objectives of the Study
This study aims to examine the role played by the Federal Supreme Court in consolidating the manifestations of duality of powers within the parliamentary system by studying and analyzing the nature of the relationships within each of the legislative and executive branches.
The study seeks to examine the relationship between the two chambers of the legislative branch and to clarify the role played by the Federal Supreme Court in regulating this relationship in a manner that ensures the legislative process proceeds in accordance with the provisions of the Constitution.
It also examines the relationship between the two heads of the executive branch, namely the Head of State and the Prime Minister, and clarifies the extent to which the Federal Supreme Court contributes to defining the boundaries of their respective powers and preventing either from encroaching upon the authority of the other.
The scope of the study further extends to examining the relationship between the legislative and executive branches in general by highlighting the manifestations of mutual influence between them under the parliamentary system, as well as identifying the role played by the Federal Supreme Court in achieving cooperation and maintaining a balance between the two branches. This contributes to establishing the principle of balance of powers and ensuring the stability of the constitutional system.
